1 INTRODUCTION

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Studio AMA sells its products to its customers.

These conditions of sale shall prevail over any other general or special conditions not expressly approved by the seller. The seller reserves the right to modify the conditions of sale at any time. In this case, the applicable conditions shall be those in effect on the date of the order by the buyer.


2 ACCEPTANCE OF CONDITIONS

Any order appearing on the website www.ibkki.com shall imply acceptance of these General Terms and Conditions. Any order confirmation shall entail full and complete acceptance of these General Terms and Conditions of Sale, unreservedly and without exception by the customer.

The data provided and the recorded confirmation shall constitute proof of transaction.

The customer shall declare to be completely aware of this.

The order confirmation shall be taken in lieu of signature and acceptance of the operations carried out.

A summary of the customer order information and these General Terms and Conditions shall be communicated to the customer in PDF format via the order confirmation e-mail address.


3 ORDERS

The customer can order on the Internet via www.ibkki.com

The contractual information shall be presented and confirmed in French, at the latest, at the time of validation of the order.

Studio AMA reserves the right not to record a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

The information indicated by the customer, when entering information linked to an order, shall bind the latter. Studio AMA shall not be liable for errors made by the customer, in the contact details of the recipient of the order (delivery address, billing address in particular) nor for delivery delays or the inability to deliver the products ordered on account of these errors.


4 PRICES

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

In the case of an order to a country other than mainland France, the customer shall be the importer of the product(s) concerned. Customs duties, or other local taxes, or import duties, or state taxes may be payable. These duties and amounts are not the responsibility of Studio AMA. They shall be payable by the customer and are his sole responsibility, both in terms of declarations and payments to the relevant authorities and bodies in his country. We advise the customer to inquire about these aspects from the local authorities.

All orders shall be payable in euros.

Studio AMA reserves the right to modify its prices at any time, but the products shall be invoiced on the basis of the price in effect at the time of validation of the order and subject to availability.

The products shall remain the property of Studio AMA until full payment has been made.

Please note as soon as the customer takes physical possession of the products ordered, the risk of loss or damage shall be transferred to him.

The price indicated in the order confirmation shall be the final price inclusive of all taxes and including VAT. This price includes the price of the product and the costs of handling, packaging and transportation.


5 PAYMENT

Confirming an order shall imply the obligation to pay the indicated price.

Payment for purchases shall be made by bank card using the secure Stripe system.

The price of the products shall be payable in full by the means of payment offered on the site on the day of the actual order.

In accordance with the Data Protection Act of January 6, 1978, the customer shall have, at any time, the right of access, rectification, and opposition to all of his personal data.


6 RETURNS

In accordance with the provisions of article L.121-21 of the Consumer Code, the customer shall have a withdrawal period of 14 days from receipt of his products to exercise his right of withdrawal without having to justify reasons. nor paying a penalty.

Return procedure:

  • The customer shall send the withdrawal form (to be downloaded at bonjour@ibkki.com).

  • The customer shall receive an email confirming receipt of the form and the processing of his request.

  • The return shall be made by post to our logistics centre in La Courneuve (full address on the return slip). Return costs shall remain the responsibility of the customer. Products must be returned in their original condition and packaging, accompanied by a copy of the invoice. Damaged or incomplete items will not be taken back and will be returned as is, at the client’s expense. It is strongly recommended to send a package by registered post, otherwise the customer shall remain liable in the event of loss of products during transport.

  • On receipt of the package by ibkki.com, a confirmation email shall be sent to the customer informing of the handling of his refund, which shall be received within 14 days.


7 AVAILABILITY

Studio AMA products can be purchased as long as they are visible on the website www.ibkki.com and within the limits of available stocks.

In case of unavailability after placing an order, the client shall be informed by email. The order shall be automatically cancelled and no bank transaction shall be made.

In addition, the website www.ibkki.com is not intended to sell products in large quantities. Consequently, Studio AMA reserves the right to refuse large orders of identical items.


8 DELIVERY

The products shall be delivered to the delivery address indicated during the ordering process, within the period indicated on the order conformation page.

In the event of a delay in shipment, an email shall be sent to the customer indicating a possible impact on the delivery time.

In accordance with legal provisions, in the event of late delivery, the customer shall have the option of cancelling the order under the terms and conditions defined in article L 138-2 of the Consumer Code. If in the meantime the customer receives the product, Studio AMA shall reimburse and cover the shipping costs on receipt of returned goods, under the conditions of article L 138-3 of the Consumer Code.. 

Studio AMA processes orders during working days (Monday to Friday, 9 a.m. to 5 p.m.).

Deliveries to France and Europe shall be handled by Collissimo, a postal service. Delivery shall be made to the address provided on the order form, or to a post office, against signature. This involves the French postal service as well as that of the country of delivery.

Each package delivered in France shall be insured against loss or damage.

For shipments outside Europe, deliveries shall be handled by Collissimo International.

Delivery costs shall be calculated automatically as soon as the customer finalizes the order and shall appear in the total payable. The amount shall depend on the product, the delivery area and the service chosen.

For deliveries outside the European Union, French VAT shall not be applied. Customs charges may be requested on delivery and shall be the responsibility of the customer.

Studio AMA shall not be held responsible for late delivery due exclusively to the unavailability of the customer after several delivery attempts.

Studio AMA shall be released from its obligation to deliver in cases of force majeure such as war, riot, fire, strike, accident, or in the event of Studio AMA suffering supply complications.

Should delivery be required to two different addresses, the customer shall place 2 separate orders.


9 LIABILITY

The products offered comply with current French legislation. The responsibility of the company Studio AMA can not be engaged in the event of non-compliance with the legislation of the country where the product is delivered. It is the customer’s responsibility to check with local authorities.

Studio AMA shall not be held responsible for damage of any kind, whether material or corporal, which could result from a malfunction or misuse of the products sold. It shall be the same for any minor differences to the products presented on the website.

The liability of Studio AMA shall, in any case, be limited to the amount of the order and Studio AMA shall not be held responsible for simple errors or oversights which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the customer and Studio AMA reserve the right, before any legal action, to seek an amicable solution.

Otherwise, for commercial customers, the Commercial Court has sole jurisdiction, regardless of the place of delivery and the accepted method of payment.


10 APPLICABLE LAW IN THE EVENT OF LITIGATION

The language of this contract is French. These conditions of sale are subject to French law. In the event of litigation, the French courts shall have sole jurisdiction.


11 INTELLECTUAL PROPERTY INTELECTUELLE

The entire site is the exclusive property of Studio AMA. No reproduction or representation shall take place without the prior written consent of Studio AMA.


12 PERSONAL INFORMATION

Studio AMA reserves the right to collect personally identifiable information and personal details concerning you. It is necessary for the processing of your order, as well as for the improvement of the services and information we send you.

It can also be shared with companies that contribute to these relationships, such as those responsible for the execution of services as processing and payment orders and orders for their management, execution, processing and payment.

13 INFORMATION STORAGE

Studio AMA shall archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized registers of Studio AMA shall be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
